Website Terms of Use
1. Scope of Application
These Terms of Use govern the use of the publicly accessible websites of N824 (operated by N824 GmbH i. G.), including all landing pages, information pages and freely accessible content. Separate contractual terms (GTC / SaaS Terms) apply to the use of the N824 PMS & Channel Manager and other SaaS services.
2. General Use of Content
The content on our website is provided for general information about N824, our products and services. It does not constitute legal, tax or other professional advice and cannot replace individual professional advice.
You may only use our website in compliance with applicable law and these Terms of Use. Misuse (e.g. attacks on the infrastructure, large-scale automated scraping) is not permitted.
3. Website Availability
We aim to keep our website available without interruption. However, temporary restrictions or outages may occur, in particular for technical reasons (e.g. maintenance, security measures, network disturbances). There is no entitlement to constant availability.
We reserve the right to adapt, extend or discontinue website content or features at any time.
4. Registration, Accounts and Access Data
Where the website offers registration options (e.g. for trial access, demo accounts or customer logins), the relevant contractual terms (GTC / SaaS agreement) apply in addition.
You must keep your access data confidential and protect it against unauthorised use by third parties. If you suspect unauthorised access, you must inform us without delay so that accounts can be blocked or credentials changed.
5. Links and Third-Party Services
Our website may contain links to external websites or embedded third-party content (e.g. videos, maps, fonts, scripts). We are not responsible for such third-party content; the terms of the respective third-party providers apply.
Links and embedded content are provided to make our information more user-friendly. We check linked content for obvious legal violations at the time the link is created, but do not monitor it on an ongoing basis.
6. Intellectual Property
Website content (texts, graphics, logos, layouts, concepts) is protected by copyright, trademark and other intellectual property rights. Any use beyond what is permitted by law (in particular reproduction, distribution, making available to the public, modification) requires our prior written consent.
Purely private, non-commercial use within the normal use of a website (reading, viewing, storing pages for personal use) is allowed.
7. Liability
We are liable for intent and gross negligence as well as for damages resulting from injury to life, body or health in accordance with statutory provisions.
In cases of ordinary negligence, we are only liable for breaches of material contractual duties (cardinal obligations), i.e. duties the fulfilment of which enables proper use of the website and on which you may regularly rely. In such cases, our liability is limited to typical, foreseeable damage.
Any strict liability without fault is excluded to the extent permitted by law. Mandatory statutory liability provisions, for example under product liability law, remain unaffected.
8. Changes to these Terms of Use
We may amend these Terms of Use if the legal framework, technical conditions or our services change. The current version is published on this page.
For material changes, we will draw attention to the new version within the website (e.g. by a banner or appropriate notice).
9. Applicable Law and Jurisdiction
These Terms of Use are governed by German law, excluding conflict-of-law rules. Where legally permissible and contractually agreed, the courts at the registered seat of N824 GmbH i. G. in 76337 Waldbronn shall have jurisdiction for disputes relating to use of the N824 website.
10. Relationship to Other Contract Documents
These Website Terms of Use govern only the use of publicly accessible web content. Separate contractual documents (GTC, DPA, booking terms) apply to:
- the contractual use of the N824 PMS & Channel Manager and other SaaS services,
- data processing as processor (DPA),
- any direct bookings or B2C services.
At the time of contract conclusion, the relevant documents are specifically highlighted, linked and must be accepted by the contracting party.
